More Ebay advice needed !Looking for opinions, I was looking thru the listings and came accross an original Davis gas engine...this thread has 34 replies and has been viewed 988 times

Looking for opinions, I was looking thru the listings and came accross an original Davis gas engine catalog. It had a "Buy it now" price of $15.00. I bought it and paid for it with Paypal. Now the guy tells me it was a mistake and he wants to relist it at a higher price. He had 3 other farm type catalogs all with the same deal buy it now for $15.00 It may have been a mistake, I don't know. But I would be willing to bet that someone has contacted him and offered more $$$ So here is my question Should I just let go of it, I really do want this book Or should I make him hold up to his listing. Thanks Mike

Its a binding deal. If he backs out you can contact e-bay and he could lose his selling privaleges. Plus you could leave him negative feed back' buy the book and its his tuff luck.

Mike, I just had to reply to your... well... situation. To let you know my opinion has some foundation, I got ripped off by an ebay seller that finally "got around" to sending it. When it arrived, it was very much misrepresented. I called his attention to this and he said he would gladly send me a refund including the cost of postage. Despite the misrepresentation, I still wanted this engine and told him to just reimburse the cost of shipping and everyone will be happy. To make a long story short, after sending me bunches of swear words and a total lack of cooperation, I threatened him with negative feedback, to which he replyed, "go ahead, but I will also return the same feedback on you". A year later we are still at the level of a cold war. Now... some of the sellers out there are gonna become quite defensive as if I'm suggesting all sellers are the same AND THEY ARE NOT ! It seems to me if you "let go", your gonna lose something you want ( and at a good price I might add ) but if you hold your ground on this deal, he can burn your ass in a multitude of ways, negative feedback, simply not sending the book, destroying or defacing portions of pages, on & on. In many cases the seller has the advantage over the buyer or so it seems. My guess would be that your correct that he was offered a larger sum of cash and "money talks". I don't know if I learned anything by my experience with one of the bad apples or not and I don't want to suggest anything to you one way or the other. Not as though it's of any help, least you know your not alone and I personally would back you up on whatever decision you make. May the force be with you !

IMHO, you made a legitimate purchase, fair and square. How easy would it be for someone to say they made a "mistake" when an item did not reach the amount they'd hoped for. Maybe I'm being a harda**, but he made the offer, you accepted and paid. That spells done deal to me. Chris |

You and he made a legitimate deal and both of you should stick to it. It was his mistake not your's. So that's not your problem, it's his. I have made mistakes and when I realize that it was my mistake, I live by it. And I expect everyone else to do the same. I am not one to back into a corner and take abuse from someone else. And I don't believe these guys should be allowed to get away with such as this. The more they get by the more they will be dishonest. I would fight him to the end. If he did something to me, leave negitive feed-back on me, etc. So be it. But I think I could get just as nasty, and stay in proper limites, as he. I have no respect for these guys, and if possible I don't think they should get away with such as this.

what about the guys who don't put a reserve on a auction and then end the auction at the last second because it hasn't brought what they wanted and then turn around and offer me the item for what they wanted to get out of it when I had won the auction for alot less. What can ya do about these kinda guys?

He probably did get a better offer. If he refuses to ship:
1. Complain to PayPal 2. Complain to EBay 3. give him negative feedback. John |

You bought it for $15. So you have to get it for $15. He had looked 7 days long every single day how much was bidding on his stuff. If there was a fault he had seen it 7 days long. The answer is simple IMHO, he's a neck talker ( Dutch saying )

No It was not on for seven days, Maby not even 7 hrs. He listed it with " BUT IT NOW " at $15.00 so I did, he takes paypal so that is how I paid. It was after I PAID for it and got my reciet from paypal that he said he wanted to refund my paypal account!!! I like the advise I have gotten so far from everyone. That is what I thought too thanks all Mike

I just sold accouple of fishing reels on Ebay I had in the discription Shiping was Ten dollars But thwn I saw later on bottom it said Shiping eight dollars. Well I charged the guys Eight Dollars. Was My mistake So I lose . But There Happy and all is well. Think he needs to eat his loss and get a good feed back and move on . especially when your talking afew dollars. If it was a mistake that the buyer clearly new it was ,then buyer should be decent about it .

Bob Miller is exactly correct. The SELLER screwed up, not YOU. Maybe he'll pay closer attention next time but I'll tell you this, and this has happened to me too, SOMEONE offered a BUNCH more $$$ for that Davis book!!! I'll guarantee it and he's trying to screw you. You are in the right here and I would file a complaint with eBay. Craig

I have had close to the same experience watch that the seller doesnt try to make up the price diffrence on the shipping. He may get away with that by saying buyer wouldnt pay freight. Good luck.

Get his phone number, call him up, tell him you are going to hold up your end of the deal (paying him) and he needs to hold up his end of the deal (sending you the book). Give him negative feedback if you get the book or not! I don't think it's used enough to shed light on problem sellers.

I had this happen to me once on eBay a year or so ago. A guy had a nice original Monitor catalogue #51-E, that is the engine catalog from 1924. It was in pristine condition and the "buy it now" price was $12.50. I did the buy it now thing and then emailed the guy right away to seal the deal. I thought about it and then emailed the guy again, before he even replied to the first one, and told him that his catalog was worth at least $100, and that I would split the difference with him and give him $65 for the catalog, and he had to cover the shipping. I received a reply from him saying that he appreciated it and he offered me Catalog #66 (repair parts, 1939) and a few broadsheets advertising the pump engines for another $25. I like a bargain as much as the next guy but, believe it or not, even I have a conscience and dealing square with a guy has always returned huge dividends to me. If you go above and beyond, folks remember you. If I were you, I would tell the guy that a deal is a deal, and while you don't have to give him anything extra, you want to be fair. Just my opinion, take it as you like.

I did not read the complete thread,but, A DEAL IS A DEAL!!! THERE WAS NO MISTAKE, E bay gives you several checks before your auction is posted...You would realy have to rush through to get the BUY IT NOW price wrong!!! For the cost of $15.00* I would just send it to him saying hear is the money.......I expect you to be a honorable gentleman and coplete the transaction in a timely fashion. The rest is up to there sence of fair play ...............chances are you will recieve your merchandise

I agree. Once you put up something on eBay, and get the reserve price, you cannot back out. If the reserve was not met, then he has the option not to sell. A deal is a deal. Make him stick to it. If he damages the catalog (or does not deliver it at all), pass it along to eBay, along with all correspondance you had with him. Give him negative feedback, and say exactly why. Stick to your guns!

The seller should leave feedback first. So if you get the book and he leaves good feedback do the same..

If you have already paid via PayPal there can be no additional shipping charges, correct? You are probably correct that he has been offered more after the sale was closed by the "Buy it Now". The most that can happen is that you will never receive the item because the delivery will probably not be insured. I hope you have saved the messages saved from the seller. Post no feed back until it is a done thing. I would not give in to his wishes. You are in the right and the seller is in the wrong in my opinion. Helen
