If the IRS wants to collect taxes on eBay sales, it better tax every flea market and yardsale across the nation just the same.

I sort of agree with you Keith....except there are a LOT of people who have made Ebay their BUSINESS.....but it's NOT a SALES TAX issue....it is a TAXABLE INCOME issue.
The occasional seller, like a yard or rummage sale, I think should just be left alone but when you see THOUSANDS of transactions by certain sellers and even their Ebay STORES...the line has been crossed and YES, they should be taxed on the income derived from their sales. I have to collect sales tax on MY taxable sales so they are STILL getting off easy. |

It is just like any thing, there are even flea market people who (Given The Chance) like the article says buy in bulk specifically to resell at a profit and lots of it. I see them at the engine shows all the time. Don't get me wrong, I am on your side on this issue. But the way I see it all the eBay vs fleamarket/yard sale taxes is like a woman being pregnant. You can't be just a little bit pregnant. So either they are going to establish, implement and enforce a tax code across the board or they can just keep their nose the heck out of it!

I am not sure how it works in other states but in Wisconsin you are and as far as I know always have been required to pay a use tax on purchases you have made from out of state. There is a little box on the state income tax form just for it. Purchases made on the internet fall right in here it is just that with the internet they have some chance of enforcing, and collecting.

Here in MN I believe the law states if you have or sell at more then one garage sale or flea market a year you are supose to charge a sales tax. I am sure every state sonner or later will get there finger into ebay.

I asked my accountant about this issue last week. He said that as long as I was selling my personal stuff it was not a business. He said my plan to sell several thousand dollars woth of china and stuff for a vacation was ok.
Just one CPA's view. I think not upgrading to a Business or Premier account is important too. I sell as the need for trip money arises. Mel |

gentlemen i believe you are supposed to report the income collect or pay sales/use tax. i think it is like yard sales & magazine ads in that the democrats have not come up with a system to monitor or enforce this. personaly i think there should be a dollar limit and exemption for the small casual sales.
