Exclamation Pennsy Ebay Auctions NOTE!!!

Just saw this news alert on AOL - State of Pennsylvania is now beginning to enforce their law on forcing EvilBay sellers to obtain a license! there are now several sellers under investigation, and the state wants to fine them $1,000 each There is an effort underway to correct this, but the workings of government... If you want to get a license, the news alert says it can take up to 8 months to obtain I wonder how much the license goes for? Is it worth it to get it, if you want to sell a $10.00 item?
Andrew

As I see it, that is only if you are a drop-off, selling other peoples stuff. It is an auctioneer's license. The only person that we have offering this service in our immediate vicinity is a licensed auctioneer. He only accepts items starting at $30 and up. Do a google search for "pennsylvania license for ebay sellers"....Helen

Andrew,

In Ohio, to get a ticket you need to
(1) find a sponsoring Auctioneer
(2) Take and pass the apprentice auctioneer test
(3) serve no less than 12 monthes and sell at no less that 12 sales
(4) attend an Ohio certified auction school (84 hrs) ( could be anywhere )
(5) Take and pass the master auctioneer test

The License is $100.00 (yr)and then you have the cost of the $10,000.00 bond ($40-70 yr)
and insurance is a good idea unless you have nothing to loose($400.00 yr)

The hard part is finding an Auctioneer who will sponsor you to become his competition in his local area < My sponsor was on his way to retirement and I helped him for years and even co wrote auctions with him, unlike many of those he was kind enough to sponsor in the past.

Ohio is looking at drop sites but no movement yet there.. Ohio has cracked down on charity auctions and require an auctioneer to do the event under contract and bond. This cuts out the office, victim, loud mouth or clown and makes more paperwork for the auctioneer, usally at the same pay ($0)

Make no mistake, this is a TAX. Plain and simple. The government goons have been frustrated that they can't easily tax internet sales so this is what they are doing about it. a TAX...a redistribuiton of the fruits of your labor if you will...a form of penalty for being productive...the one thing that any true american should bristle at the mere mention of.

Oh sure, it is only a couple of states and primarily directed at business users but anyone over the age of 3 knows about letting the camel's head under the tent. Anyone who thinks they will stop short of attacking the individual sellers is either dishonest with themselves or just plain naive.

This is a situation that more people should be making some noise about.

Hasn't a high court somewhere ruled that for ebay auctions, ebay is the auctioneer, thus negating the need for any individual to hold a license?

I do believe ebay is a licensed auctioneer in all 50 states.

ebay has to be licensed otherwise they couldn't operate. This separate license to me sounds like another way to get the working man's money. AS USUAL. It doesn't make sense because ebays practically went through all licensing needed...all you do is be an honest customer and pay your fees if your a seller. I can see if this is a way they may be attempting to filter the scammers out of ebay, and i can see that this would be a very effective method FOR such a defense against scammers because their game is not pay...it's lie and steal, so ya, very effective BUT....that's the same thing as trying to "put an end to terrorism" it's an age old thing thats been here since time itself. Just spinning your wheels. Plus if the license were to go into effect with 50 percent of it's customers...OR EVERYONE...and at the price a license costs!? ....they'd lose so many customers it'd probably put ebay under. UNLESS you have some VERY LOYAL customers out there....and not everyone is that loyal....I for one...would no longer be on ebay which would be a partial tragity for not only me but for everyone or just about everyone in the engine and car hobbys due to (i'll admit, i get A LOT of parts from ebay) and im sure the majority of you do as well. so it's really an on going battle.....its more like...if they wish to make over the net licensing a necessity upon using ebay....it's not really the governments decision to make....it's ebays...UNLESS the government pushes them into acting so....and to that...ebay will lose a lot of customers. so i hope this licencing really ceases to exist....at least for most of ebays customers. The price of a license will not justify using ebay, which defeats the whole entire reason, one of the reasons WHY ebay was created. To make it easy for the average joe to sell and buy items and its cost is very minimal. a license will defeat that whole scenario. ..but then again....that's what part of the govorment is about anyway BUT....that's another story.

If/when that happens, I will be cancelling my eBay account. Between their fees and PayPal fees, it already costs quite enough to sell small ticket items - heck, it even costs plenty to sell big ticket items.

Craig's list is still free

They are called EvilBay because they are EVIL!

I recently bought a car from there... salvage title, asked the seller lots of questions as to whether there was anything wrong, how well it was fixed, etc. Everything is great, no issues, no problems he said.

I got there and the car is not safe to drive, warning lights on for ABS and AirBags. I say misrepresented and I want my money back. No go says the guy.

I figured I could get my money back via eBay buyer protection - nope, since it is salvage title there is absolutely NO protection. Contact PayPal and they say the deposit on a car is not a tangible item so NO protection from them either!

Finally got some of my deposit back by contacting my credit card company and having them go after the guy. Didn't get it all back, but I'm satisfied because there was no way I was taking that car!

Lesson learned: Don't send a deposit, don't give any money until you've seen the car. AND, always pay with credit card if you are using PayPal so you have another way of disputing...

This is only the second time in around 250 transactions I've encountered a liar. Both times were people selling vehicles... I have bought three vehicles with no problems through eBay.

I just did a search through the Ohio dept. of Ag Auctioneer enforcement Div. and nothing listed under Ebay as being an auctioneer or auction company. Could be under another name of sorts but as I remember Ebay runs as it is w/o the laws that I must follow to sell other peoples items

And that hold the same for tag sale firms

Two choices, loosen up my regulations or tighten theirs!

I don't like Craiglist boring.... I am happy with Ebay. I bought a lot original literature and catalogs for lot less money than the dealer in flea market. Dealer in flea market sell a rare steam or tractor catalog/ book for 250.00. I buy on eBay for 20 or more dollars. Flea market dealer sold to computerless or ebayless people for profit. Surf online Save time traveling and gasoline expenses.
